YOUR BUSINESS. DEFINED OWNERSHIP.
Own your platform.
Understand what that includes.
Custom software can reduce dependence on per-seat subscriptions for the workflows it replaces. Ownership and operating responsibilities should be explicit before development starts.
Your content and business records
You retain your rights in the logos, photographs, copy and business records you supply. Your agreement should define permitted service access, data exports, retention, deletion and transition assistance. Customer records remain subject to the privacy and confidentiality duties that apply to your business.
Custom application code
The signed agreement must identify which custom deliverables are assigned or licensed to you, when those rights take effect, whether payment is a condition, and which source code and documentation are delivered. A marketing statement about ownership does not automatically transfer every component or every provider account.
Third-party components
Open-source libraries, fonts, licensed assets, payment services and external APIs retain their respective licenses and terms. Hosting, authentication, email, storage, AI models and specialist integrations may have recurring or usage costs. Replacing selected subscriptions does not eliminate infrastructure costs or automatically reproduce every feature of a mature software suite.
Accounts and handover
Agree who owns the domain, source repository, hosting, database, email and payment accounts, who administers them, and how access is transferred. A client-owned deployment and a provider-managed deployment can have different handover responsibilities. Confirm export formats, credential transfer, assistance costs and any dependencies that must remain active.
Ongoing management
The service agreement should assign responsibility for updates, monitoring, access reviews, backups, restore testing, incident response and renewal costs. Define support hours, response targets and recovery objectives if needed. We do not describe an untested backup or an unconfigured control as operational.
Approvals and changes
Approve requirements, designs, milestones and launch readiness against agreed acceptance criteria. Out-of-scope changes need a separate approved quote before billable work begins. The portal helps retain supported approval records; the proposal establishes the commercial terms.
Regulated workflows
Medical, legal and financial applications require additional design and review for their actual data and operations. Public demonstrations use fictional records and do not establish HIPAA compliance, trust-accounting suitability or any other certification. Required vendor agreements, controls and testing must be completed before restricted information is introduced.
